The Education Section is primarily responsible for providing the full range of legal services to State education agencies, i.
e.
, the State Board of Education, the Department of Public Instruction, The Board of Governors of the University of North Carolina, the constituent institutions of the University, the North Carolina State Education Assistance Authority, the North Carolina School of Science and Mathematics, the State Board of Community Colleges and the Department of Community Colleges.
The primary purpose of this Attorney IV position, which is funded by the University of North Carolina, is to independently litigate tort claims, which often involve complex, novel, and precedent setting-legal matters, filed against the constituent universities in the North Carolina Industrial Commission and in the General Courts of Justice.
In addition, the Attorney IV will independently handle litigation filed pursuant to the NC Public Records Act in State Civil Superior Court.
Responsibilities and Duties: This Attorney IV is independently responsible for all aspects of complex and significant litigation involving tort claims filed against the University of North Carolina, its constituent institutions and their administrators, faculty and employees.
The Attorney IV independently litigates trials and appeals in these complex matters in state courts, federal courts, the Industrial Commission, and state and federal appellate courts.
This position is exposed to a range of interesting and challenging issues relevant to higher education institutions and has the opportunity to interact regularly with the General Counsel throughout the University of North Carolina, which includes the System Office and the 17 constituent campuses.
The Attorney IV serves as an expert resource for the universities in making risk assessments before and after litigation has been initiated.
The Attorney IV works independently in determining case strategy, developing litigation tactics, and conducting litigation which impacts the jurisprudence of the State.
This Attorney IV prepares formal and informal opinions in response to questions regarding the interpretation of State and federal statutes and regulations affecting the University of North Carolina, including but not limited to the NC Tort Claims Act and the NC Defense of State Employees Act; participates in various professional service activities, including CLE presentations on areas of expertise; and answers correspondence and telephone inquiries from the public on issues regarding or affecting the University of North Carolina.
This attorney handles criminal briefs on appeal by the defendant to the North Carolina Court of Appeals and the Supreme Court.
This position is responsible for providing supervision of and training to other attorneys in the Section on a case-by-case basis as assigned by the Section Head.
**Management requests that a writing sample is submitted of a brief filed in litigation, preference for civil litigation.
This position requires travel, including overnight travel, as part of its assigned duties.
The caseload and other responsibilities may occasionally require that additional hours be worked.
Hybrid telework opportunities are available for this position.
Note to Current State Employees: The salary grade for this position is LG09.

Knowledge, Skills and Abilities / Competencies Knowledge of federal and State case law, and administrative rules and regulations, especially in the area of tort litigation in the Industrial Commission and in the General Courts of Justice.
Knowledge of State and federal evidentiary and procedural rules, including those of the Industrial Commission.
Excellent multitasking, organizational, supervisory, and managerial skills.
Excellent research and writing skills and oral communication abilities.
Ability to independently perform complex and advanced legal support work.
Ability to work independently in determining case strategy, developing litigation tactics, and conducting litigation.
Ability to analyze facts, conduct discovery, conduct research, draft pleadings and briefs, argue to the court and conduct litigation in complex cases.
Ability to determine the potential for settlements, negotiate terms for settlement, and recommend settlements.
Ability to communicate effectively with a diverse population ranging from high-ranking government officials to hourly employees.
Ability to oversee the work of other attorneys who assist in the handling of special projects cases.
Ability to establish and maintain effective working relationships and to collaborate across all sections and divisions within the Department of Justice, and with its client, the University of North Carolina and the constituent institutions.
