*JOB DESCRIPTION* *Job Title: *Agency Attorney *Department: *Administration *Immediate Supervisor: *Executive Director *Positions Supervised: *Paralegal (who supports the Agency Attorney and Ethics Counsel) *Purpose of the job*: Advising the Executive Director on administrative and legal issues relative to the operation, administration, and regulation of the State Bar; managing specified programs and responsibilities of the State Bar; responding to legal questions of the State Bar’s boards and committees.
*Essential Job Responsibilities:* · Research, advise the Executive Director, officers, boards, and committees, and write opinions on legal issues relative to the State Bar’s operations and responsibilities, including the applicability of _Keller_ and its progeny as well as employment law and ADA issues · Counsel to the Disciplinary Hearing Commission (tentative) · Counsel to the Communications Committee and Publications Committee · Counsel to the Legal Assistance to Military Personnel (LAMP) Committee · Staff to other committees and subcommittees as assigned · Track and coordinate the State Bar’s rule amendment process · Serve as a central clearinghouse for all public records requests; prepare responses working with the appropriate departments; log requests and responses · Manage the State Bar’s prepaid legal services registration program · Manage the State Bar’s compliance with open meetings law · Review of contracts including for event facilities, leased premises, hotel contracts, and IT services · Investigate and advise on insurance policies and coverage levels · Oversee the State Bar’s document retention responsibilities, including remaining current on requirements and procedures of the Department of Natural and Cultural Resources and the State Bar’s functional schedules · Oversee outside litigation as assigned by the State Bar Counsel · Manage disbursements from the State Bar trust account maintained for client funds received from abandoned law practices.
· Other duties as assigned concerning administrative or legal issues related to the State Bar’s operation and responsibilities *Accountability and Authority* Agency Attorney reports to and is directly supervised by the Executive Director.
Agency Attorney receives instructions from board and council members in connection with board and committee work.
Agency Attorney is expected to autonomously exercise discretion in fulfilling the usual responsibilities of the job and to perform the job with minimal supervision.
*Desired Education, Experience and Skills:* · Law degree; North Carolina law license, with no professional discipline, required.
· At least five years of experience in the practice of law · Proficiency with Microsoft Office programs; general familiarity and comfort with computer operations, including videoconferencing (e.
g.
, Teams, Zoom); general familiarity with social media (platforms, equipment used, etc.
) · Excellent written and oral communication skills · Substantial organizational skills for carrying out large projects · Strong writing and legal research skills *Working Conditions:* · Position is exempt in accordance with the Fair Labor Standards Act · Hours: 9:00 a.
