The primary purpose of the North Carolina Department of Justice is to provide legal service to state government.
The primary purpose of the Transportation Division of the Department of Justice is to represent the North Carolina Department of Transportation (DOT) (including the Division of Motor Vehicles (DMV)) and the Board of Transportation.
This position is responsible for coordinating and preparing the highway condemnation actions in the superior courts of the 100 counties of North Carolina.
These actions must be filed in a timely manner to acquire the land necessary to begin the Department of Transportation’s construction projects on schedule.
The Paralegal I researches and compiles information of a legal nature which must be obtained before the filing of a lawsuit.
Coordinating and preparing condemnation actions.
Verification of critical information: The Paralegal I reviews the DOT Right of Way Unit file and the preliminary title opinion submitted by the title attorney to make sure the critical identifying information is correct and current.
Coordination with client agency: The Paralegal I coordinates with the Right of Way Unit to maintain a filing schedule to meet the agency needs while balancing the workload to the section.
Maintenance of tracking system and case list: As each claim is submitted, the Paralegal I enters into the Department of Justice Legal Case Tracker case management system information as to project number, county, property owner name, names of other parties, and key contacts in the client agency.
Distribution of papers: Final papers are sorted and mailed to respective superior court clerk’s offices, registers of deeds, and appropriate persons such as the abstracting attorney, state locating engineers and Division Right of Way personnel.
Case List Maintenance: The Paralegal I reviews the filings and entries into the Legal Case Tracker and each month prepares a list of pending cases which is distributed not only within the Transportation Division but also throughout the client agency.
Assistance in preparation of criminal briefsThe Paralegal I assists assigned attorneys in the preparation and filing of approximately three to five criminal briefs per year.
The Paralegal I notifies the defendant’s attorney that the Record on Appeal has been received and identifies the attorney who will be writing the Brief for the State.
The Paralegal I transcribes the attorney’s dictation or writing into a brief properly formatted according to the Rules of Appellate Procedure and prepares an index and table of authorities.
Assistance in providing other legal servicesThe Paralegal I assists in reviewing final title opinions for files in service to see if correct defendants, the correct court file (CVS) number, the correct project number, and the correct parcel number are included.
The Paralegal I coordinates with the Attorney responsible for the filing of the condemnation cases and the head of the Condemnation Section to assure that all legal tasks are complete.
Note to Current State Employees: The salary grade for this position is LG03.
State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position.
