The primary purpose of this position is to provide a full range of legal services to the Division of Public Health within the Department of Health and Human Services.
This position represents the client agency in appeals of public health cases in the State appellate courts, litigation in the federal and State courts and in administrative hearings before the Office of Administrative Hearings.
Represents State Agencies and Employees in Civil LitigationThis position handles highly complex litigation, often involving cases of first impression in which the public health is at stake.
This position is responsible for handling much of the major litigation involving more complicated legal issues that arise from representation of the public health sections within the Division of Public Health.
This includes federal litigation such as 1983 actions, defending actions by the State Health Director under his broad discretionary authority, issues involving communicable disease control and the confidentiality of medical records, complex litigation in State and federal courts and the Office of Administrative Hearings that has a broader impact on State programs, defense of suicide determinations by the Chief Medical Examiner, highly publicized cases often involving imminent health hazards, and other complex litigation involving the Department of Health and Human Services.
Counsels on Public Health Legal IssuesThis position advises the State Health Director and all public health sections within the Division of Public Health, Department of Health and Human Services.
This position also communicates with local health departments, county attorneys, district attorneys, magistrates and judges on legal issues involving public health matters.
Much of this time is spent assisting state agencies and counties in pursuing enforcement of public health laws, including guidance on litigation and taking preventive measures through skillful negotiations and counseling to avoid potential litigation.
Advises/Represents Boards and CommissionsThis position serves as counsel for the North Carolina Commission for Public Health, which is the Commission responsible for all state agency rulemaking governing public health.
This position also represents the State agency in all aspects of rulemaking proceedings before the Commission for Public Health and the North Carolina Rules Review Commission.
This includes reviewing and drafting proposed state rules, advocating before rulemaking bodies, and ensuring rules are implemented in accordance with the requirements of the North Carolina Administrative Procedure Act.
Represents State in Criminal AppealsThis position serves as attorney for the State when convicted criminals appeal from judgments entered pursuant to trial or engages in other post-conviction practice, including motions for appropriate relief, stay of sentence and writ of supersedes.
The duties involve analysis of legal issues, legal research, preparation, as appropriate, of pleadings, memoranda of law, appellate briefs and presentation of oral arguments in the appellate courts.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $89,775 to $118,695.
Salary determination is based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations.
Note to Current State Employees: The salary grade for this position is LG09.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity.
