This position provides a unique opportunity for an attorney who seeks a practice that encompasses numerous areas of the law and who enjoys interesting, complex and often significant litigation, impacting vital functions of state government.
Overview of Property Control Section The primary purpose of the North Carolina Department of Justice is to provide legal services to state government.
The primary purpose of the Property Control Section of the Civil Division of the Department of Justice is to represent the North Carolina Department of Administration (“DOA”).
The DOA is the business arm of state government.
DOA’s divisions include the State Property Office, which buys, sells and leases real property, the Division of Purchase and Contract, which contracts for goods and services on behalf of the State, and the State Construction Office, (“SCO”) which oversees the State’s construction of buildings and facilities.
This Section’s legal work is complex and highly technical.
The transactions and litigation performed by this Section can be significant, often involving multi-million dollar claims or impacting vital functions of state government.
The Section’s work is critical to the successful operation of all of state government and involves working extensively with other state agencies.
The Property Control Section serves the legal needs of DOA by representing (a) the State Property Office in all aspects of the acquisition and disposition of interests in real property (excluding transportation projects) as well as condemnation litigation; (b) the Division of Purchase & Contract in bid practices, procurement litigation, and the review of contracts for goods and services and (c) the SCO through claims litigation, contract drafting and review, and advice to agency staff.
Other agencies and divisions within DOA represented by the Section include the State Building Commission, the Commission of Indian Affairs, Historically Underutilized Businesses, Human Resources and State Surplus Property.
The Section also provides legal advice and representation to the N.
C.
Marine Industrial Park Authority and the N.
C.
Innovation Council.
These two agencies are housed administratively within the N.
C.
Department of Commerce.
Primary Purpose of the Position The Attorney III, together with other attorneys in the Section, is responsible for providing a full range of legal services to DOA, and by extension contracting and land managing agencies.
These services include litigating cases involving DOA at the Office of Administrative Hearings (“OAH”) and at all levels of the state and federal court systems.
Litigation encompasses: the defense of the end user agency and DOA’s Division of Purchase and Contract in protests that contest the award of contracts for the provision of goods and services, representation of the project owning agency and SCO in claims that concern the design and construction of state buildings and facilities, representation of DOA and land managing agencies in disputes that pertain to State-owned real property not within the purview of the Department of Transportation, and the defense of DOA in personnel cases.
Other purposes of the Attorney III position include providing advice on contractual provisions for the procurement of goods and services, preparing, reviewing and approving as to form contracts for the design and construction of public buildings, reviewing and drafting instruments (deeds, leases, easements, contracts, etc.
) for the acquisition, management and disposition of interests in real property, assisting DOA in personnel management decisions, representing boards and commissions and providing legal advice, both formally and informally, to DOA and other agencies on a number of issues.
Note to Current State Employees: The salary grade for this position is LG08.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $84,878 to $100,179.
Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Knowledge, Skills and Abilities / Competencies The Attorney III must have thorough knowledge of general case, statutory and common law, as well as judicial and quasi-judicial procedures.
Additionally, the attorney must have the following skills/abilities: Ability to conduct complex civil litigation in trial and appellate courts.
Ability to creatively and independently develop case strategy and tactics.
Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions.
Ability to analyze facts, evidence, and legal instruments.
Ability to express conclusions and arguments clearly and logically in oral and written form.
Ability to analyze legal problems and render formal opinions.
Ability to review and draft legal documents, including contracts and instruments of conveyance.
Ability to establish and maintain effective working relationships.
The Attorney III must have a specific understanding of statutory and case law in the areas of public procurement law, construction law, contract law and real property law.
The attorney must be able to work independently when required, be adept at analyzing complex facts and evidence, and be capable of identifying creative, practical solutions to problems.
The capacity to work collaboratively with other attorneys inside and outside of the Section is essential.
Minimum Education and Experience Requirements Some state job postings say you can qualify by an “equivalent combination of education and experience.

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.
NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
Management preferences: At least one year of civil litigation courtroom experience.
