The Department of Public Safety (DPS) is one of the largest state agencies, with almost 5,000 employees and approximately 14,000 National Guard soldiers.
Thousands of juveniles are under the supervision of the Division of Juvenile Justice.
The Office of the General Counsel (OGC) provides to executive management and managers oral and formal written legal opinions on laws, constitutional provisions, administrative rules and regulations, court decisions, and other precedents impacting the department’s policies and operational procedures.
This section drafts departmental rules and regulations, operational guidelines, contracts, department-sponsored legislation, and other legal documents.
Attorneys in the OGC provide oral and written responses to inquiries by federal, state and local officials including legislators, judicial officials, law enforcement personnel, and citizens about the department’s policies and practices and the statutes and regulations it enforces.
The OGC advises the Secretary and executive management on the merits of litigation against or on behalf of the department.
As an advisor for DPS, this position is responsible the following: Providing legal advice, liability prevention strategies, and risk management services in diverse areas.
Conducting training in high liability areas for law enforcement divisions within DPS.
Plays a critical role in liability reduction for DPS.
This is accomplished through development, distribution and/or presentation of training for the law enforcement divisions within DPS.
Attending monthly meetings with several DPS Divisions for the specific purpose of issue-spotting potential and current liability, and then following-up on that liability by developing a plan to address the issue.
General day-to-day involvement with DPS employees, management, and the general counsel and attorneys in the Office of the Attorney General, including advising on the formulation of policies, procedures and rules and review of those policies, procedures and rules to ensure compliance with constitutional and statutory constraints and current accepted practices and procedures.
Addressing documents such as policies and procedures which correspond with the training material.
Responding on behalf of the Department, to subpoenas, court orders and other requests for records, including confidential personnel and records of criminal investigations.
Reviewing contracts for various divisions with DPS.
Rendering legal advice regarding complex statutes, constitutional issues, and many unique issues without legal precedent.
Serving as a liaison between DPS and the Attorney General’s Office and providing guidance as necessary or requested regarding statutes, policies and rules applicable.
Serving as a policy advisor to DPS regarding potential litigation against or on behalf of individual employees and divisions of DPS and settlement.
Upon request, assisting the Attorney General’s Office in preparation and attend mediations as a Departmental representative.
This position may be asked to do the following: Review or draft legislative proposals to ensure they are consistent with the Governor’s and DPS’s initiatives and agenda.
Assist the General Counsel and other DPS employees in articulating departmental goals regarding diverse DPS matters to the legislative.
Advise, assist, and attend meetings at the request of DPS’s legislative team.
This position is expected to operate with own judgment, skills and initiative with periodic general review from the supervisor.
Attorney must work independently, establish priorities, and meet deadlines in response to workflow.
Instructions are usually verbal and general in nature, requiring this employee to do the necessary planning and research.
Work occasionally requires travel within the state.
This position qualifies for teleworking on a part-time basis as part of a State Teleworking Program.
Any telework will be under the conditions of the State Teleworking Program Policy, and the employer may end any teleworking arrangement at any time at the employer’s sole discretion.
This is a full-time position (40 hours per week) with State Benefits.
Note to Current State Employees: The salary grade for this position is LG08.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity.
