This attorney represents DHSR and DMH, with some supervision, in all phases of civil and administrative litigation in the Office of Administrative Hearings, the General Courts of Justice, and the appellate courts.
The attorney primarily represents DHSR's (Division of Health Service Regulation) HCPR (Health Care Personnel Registry) section, but also represents other sections as needed.
Will prepare cases for hearing by reviewing patient medical records and agency's investigative files; conduct interviews; other tasks as needed in preparation of hearings.
Will conduct legal research, draft appropriate motions, draft recommended decisions, draft legal memoranda and briefs.
Must also be able to compile a record on appeal.
Other responsibilities include representing and providing counsel on collection matters; representing the State on civil appeals arising out of involuntary commitments; representing the State in proceedings at facilities; representing DMH on appeals arising out of community based mental health operations; representing DHHS agencies in matters arising out of state personnel grievances.
This position is not subject to the Fair Labor Standards Act.
Note to Current State Employees: The salary grade for this position is LG07.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $70,732 to $85,552.

A thorough knowledge of the statutory law and common law of the state of North Carolina.
A thorough knowledge of the North Carolina Administrative Procedure Act, the North Carolina Rules of Civil Procedure, and the North Carolina Rules of Appellate Procedure.
The ability to analyze, interpret, and apply facts, rules, appellate decisions, and legal instruments.
The ability to express arguments clearly and logically in oral and written form.
The ability to determine issues in various cases.
The ability to analyze legal problems and render formal opinions.
The ability to creatively develop case strategy and tactics.
