The Workers’ Compensation Section investigates, processes and defends claims against departments, agencies and institutions of the State involving workers’ compensation law in the North Carolina Industrial Commission pursuant to N.

§97-1 and §97-88.
2, the North Carolina General Courts of Justice, and in federal trial and appellate courts.
This attorney acts as defense counsel for the North Carolina Department of Public Instruction, and other agencies of the State as needed, in legal actions brought pursuant to the Workers’ Compensation Act, N.
C.

Industrial Commission, state and federal courts.
The attorney will represent state agencies in pursuing subrogation liens, and performs such other duties as may be assigned by the Section Head.
This attorney also will represent the State in criminal appeals.
The attorney may be asked to speak at conferences and teach workshops for the client upon request.
This attorney will be assigned the most complex workers’ compensation cases involving occupational diseases, return to work issues, PTSD or multiple injuries, which may leave the State exposed to liability for years of expensive medical treatment and wage loss, vocational rehabilitation and permanent injury resulting in enormous costs.
These cases necessitate extensive investigation, expert testimony, and detailed trial preparation, and include asbestos related lung disease cases, mold cases, extended benefits cases, episode of violence cases, lien waivers in State and Federal Courts, complex accidental injury cases involving preexisting conditions and alleged exacerbations and death claims.
In addition, this position assists less experienced attorneys in the section with their cases.
Reviews other attorneys’ appellate briefs and helps coordinate benefit issues between state agencies, such as short and long term disability.
Finally, this position will assist in the supervision of the section attorneys and support staff.
Note to Current State Employees: The salary grade for this position is LG09.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $89,775 to $112,560.

Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Knowledge, Skills and Abilities / Competencies Knowledge of civil law and extensive knowledge of workers’ compensation law.
