The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions.
The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.
This position is not subject to the Fair Labor Standards Act.
This position is located in the Human Services/Medical Facilities section of the Department of Justice.
The primary purpose of this full-time position is to provide a full range of legal services to DHHS including: • The defense of civil actions brought against DHHS and its constituent agencies and its agents and employees in state and federal court and in state and federal administrative forums; • Representation of the State in commitment proceedings held at DHHS facilities; • Representation of the State in civil appeals arising out of commitment proceedings in all facilities designated by the Secretary of DHHS to involuntarily commit persons, and at facilities that admit voluntary patients who are entitled to a judicial hearing for continued commitment; • Overseeing the collection of debt owed by persons or estates due to the provision of services from a DHHS operated facility, representing DHHS in any action to collect debt, and advising DHHS concerning debt collection; • The defense of personnel/employment administrative appeals and civil actions brought by applicants, former employees and present employees of DHHS.
This includes research and the issuance of formal legal opinions relating to personnel and employment issues; • Providing legal service and representation to the Division of Vocational Rehabilitation and the Division of Services for the Blind in fair hearings and in state and federal courts.
This includes research and the issuance of formal legal opinions relating to disability and Vocational Rehabilitation issues; • Other legal services as may be required by DHHS; • Resolving complaints, and responding to inquiries on legal issues from the public; and • Representing the State on the appeal of criminal cases and perform related duties as required.
Note to Current State Employees: The salary grade for this position is LG08.

The attorney is called upon to independently conduct litigation in the administrative, trial, and appellate courts of the State and also in the Federal court system.
With litigation in such diverse court systems and districts, a thorough understanding of administrative and judicial procedures, local rules of court, and Federal and State Rules of Civil Procedure is necessary.
In addition, the attorney must be able to interpret and apply statutes and court decisions, analyze facts, evidence and legal documents, determine their significance, decide what further evidence and witnesses may be necessary and draft all legal documents necessary to the litigation.
