This position qualifies for teleworking on a part-time basis as part of a State Teleworking Program.

This Legal Consultant I position is responsible for providing legal advice, liability prevention strategies, and risk management services in diverse areas related to the policy and practices of the ABC Commission.
This position represents the Commission in 20-30 violation cases per month and in contested cases before the Office of Administrative Hearings as well as acting as in-house counsel to the ABC Commission staff.
Job duties of this position include: Handling inquiries and legal problems (including contract review) presented by more than 250 beer and wine wholesalers and 1,200 out of state importers, wineries, and breweries, which range from questions related to hours of sale to complex questions on lawfully importing wine from foreign counties and the related tax implications Liaising with local government officials to discuss the impacts of proposed local zoning ordinances and the businesses which may operate within the zones Providing guidance to local ABC Boards on proper procedures for real estate and real property purchasing or terminating contracts Reviewing requests for marketing and promotional materials from beer and wine wholesalers for compliance with the ABC Commission's extensive trade practice rules Maintaining involvement in the rule-making process Serving as a staff liaison to the legislature Conducting rule-making hearings Providing formal, written opinions interpreting state and federal statutes and court decisions and the consequences of applying the law and court decisions to agency policy, practices, and procedures which often influence policy and procedures for the department and are distributed to other agencies and state and local officials Serving as a representative of the Commission to local law enforcement jurisdictions regarding legal advice on ABC issues Receiving requests from legislators and citizens to interpret alcohol laws and regulations or opinions concerning the lawfulness of specific police activity Holding responsibility for the management, oversight, and coordination of all litigation related to the agency and its legal staff Investigating and analyzing complex factual and legal claims and formulating appropriate defenses Analyzing transcripts, exhibits, deposition testimony, legal documents, and other evidence of record in ABC violation cases and advising the Chairman and legal staff on advisability of available litigation strategies and settlement penalties Drafting final agency decisions and orders for the ABC Commission Reviewing legislative proposals to ensure that they are consistent with the agency and Governor's initiatives agenda Assisting the Chairman and division directors in articulating agency goals to members of the legislative body and drafting proposed bills when necessary Overseeing staff who establish the Commission monthly docket of cases and perform critical work in advancing the agenda of the Commission Providing mentoring and supervision to legal staff This position requires the ability to: Interpret laws, rules, regulations, and court decisions Analyze facts, evidence and legal documents Express legal interpretations or conclusions of law clearly and logically in oral and written form Maintain effective working relationships with the public and other persons contacted in the course of work Analyze decisions that will affect and impact existing procedures or statutory interpretations and develop methods to incorporate new procedures and implement new laws Serve as an agency liaison to the North Carolina General Assembly on legislative matters, including monitoring legislative activity, formulating, drafting, and soliciting legislative support for agency legislative initiatives Provide ethical answers to citizen and legislative questions or complaints Fostering good relationships between the public and the state's law enforcement agencies Conduct independent legal research and analyze the law to assist the Commission in developing effective strategies in novel or complex cases This is a full-time position (40 hours per week) with State Benefits.
This position's typical work schedule is Monday - Friday, 8am-5pm.
Note to Current State Employees: The salary grade for this position is LG06.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity.
