Description of Work This position assists the Agency Legal Counsel with litigation and provides day-to-day support to the Civil Rights Division Director.
The position will also review investigative determinations, draft memoranda, draft policies, and counsel the intake coordinator on whether the agency has jurisdiction to investigate.
The position may also provide support to the employment investigation section by drafting and enforcing subpoenas and provide counsel to the board of commissioners of the North Carolina Human Relations Commission.
The position is expected to work well with others and attend divisional meetings.
Job responsibilities include: Litigation Representing the State of North Carolina, Human Relations Commission in civil and administrative actions in cases when the agency determines there is reasonable cause to believe a discriminatory action occurred.
This includes drafting and filing the complaint, propounding and responding to discovery, conducting depositions, drafting and filing pre-trial motions, drafting trial briefs, representing the agency at trial, and drafting post-trial appeals.
Drafting and enforcing subpoenas.
Agency Work Reviewing discrimination inquiries submitted by complainants for jurisdiction, standing, and whether a claim is stated under U.
S.
and North Carolina Fair Housing Acts.
Negotiating settlements of fair housing cases.
Providing day-to-day advice to housing investigators, program managers, and Civil Rights Director.
Reviewing investigative determinations.
Drafting proposed legislation or administrative rules.
Responding to public records requests.
Conducting Outreach Training staff, Commissioners (board), and the public on fair housing law and guidance.
This is a time-limited position for one year that may be extended at the discretion of the Chief Administrative Law Judge.
Knowledge, Skills and Abilities / Competencies Experience litigating cases in North Carolina state and/or federal court Experience in drafting legal complaints/responses Knowledge of North Carolina civil procedure and rules of evidence Minimum Education and Experience Requirements Licensed to practice law by the North Carolina State Bar.
NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
