The Education Section is primarily responsible for providing the full range of legal services to State education agencies, i.
e.
, the State Board of Education, the Department of Public Instruction, The Board of Governors of the University of North Carolina, the sixteen constituent institutions of the University, the North Carolina State Education Assistance Authority, the North Carolina School of Science and Mathematics, the State Board of Community Colleges and the Department of Community Colleges.
The primary purpose of the position is to provide legal services and advice to the State Board of Education and the Department of Public Instruction.
Responsibilities and Duties: 1.
Litigation This Attorney is directly responsible for conducting complex litigation, trials and appeals in the Office of Administrative Hearings and State and Federal courts involving the State Board of Education and the Department of Public Instruction with minimal supervision.
The professional duties include researching and analyzing facts and law, drafting pleadings, conducting discovery, preparing and arguing motions, conducting settlement negotiations, presenting evidence, making jury arguments, writing appellate briefs, and arguing the case in the appellate courts.
This Attorney advises clients regarding and litigates legal issues arising from disputes involving teacher license revocations, teacher compensation, charter school revocation and non-renewals, personnel disciplinary actions, intentional torts and making and performance of contracts.

Advice and Counsel This Attorney consults with the staff for the State Board of Education and the Department of Public Instruction on the full range of legal issues arising from their administrative activities, including providing advice to the client regarding contracts and negotiating contracts, preparing formal and informal opinions in response to questions regarding the interpretation of State and federal statutes and regulations affecting North Carolina public schools; answering correspondence and telephone inquiries from the public and local school boards on issues regarding or affecting North Carolina public schools; and participating in various professional service activities, including CLE presentations in areas of expertise.

Criminal Appeals This attorney handles criminal briefs on appeal by the defendant to the North Carolina Court of Appeals and the Supreme Court.
Note to Current State Employees: The salary grade for this position is LG08.
