The primary purpose of the Paralegal II position in the Appellate & Post-Conviction Section is to provide legal, administrative and clerical support to the Supervisor and Section staff attorneys to relieve them of routine matters and, while working under their guidance, to assist them in conducting complex tasks associated with active litigation.
This support will allow the Supervisor and Section staff attorneys to allocate additional time to perform their more difficult duties.
The secondary purpose of the Paralegal II Position is to provide legal, administrative, and clerical support, including word processing services, for the Section’s staff attorneys in their preparation of briefs, motions, petitions, answers, responses, correspondence and other legal documents, as well as independently formatting and composing a variety of letters and memoranda.
Other office support functions provided by this position include file/information management, office equipment operation, and management of incoming and outgoing mail.
Document Preparation – The Paralegal II will provide paralegal and clerical support to the attorneys in the section in preparation of briefs, motions, petitions, responses, and other legal documents.
proof read, cite check, run tables of contents and authorities for briefs and pleadings generated by the section attorneys, ensuring compliance with the appropriate rules of court for format and content of filed documents.
check citations to applicable legal authorities, make corrections where necessary, and will make independent decisions upon which the Section attorneys will rely with minimal review in making the final edits to the pleadings, including direct appeal briefs filed before state and federal appellate courts.
preparation of templates for documents; proofreading and editing of all documents; preparation of Tables of Authorities, Tables of Contents, and Appendixes for attorneys’ briefs and other legal documents; citation checking; final formatting of documents prepared and typed by attorneys.
Electronic filing of documents with the appellate courts; preparation of service copies for opposing counsel.

responsible for review of all non-capital cases filed in federal district court for federal habeas corpus review, and is relied upon by the Section Attorneys who handle non-capital federal habeas corpus cases to make independent decisions in determining what documents must be obtained in order to adequately respond to the petitions.
Upon direction by the Section Supervisor and/or staff attorney, the Paralegal II will be responsible for preparing the joint appendix in the United States Court of Appeals for the Fourth Circuit in federal post conviction, which involves obtaining appropriate documents from the various court and attorney files and assembling the documents into the required format.
Document Management – The Paralegal II is responsible for setting up and updating brief templates for the attorneys assigned to them.
The Paralegal II is responsible for ensuring that each case handled by the section is entered into an electronic data base tracking system.
All relevant activity in a case will be electronically entered into and reflected by the tracking system.
At the direction of the Section Supervisor, the Paralegal II may be requested to create and maintain additional electronic spreadsheets tracking various aspects of the litigation associated with the capital and noncapital post conviction cases.
The Paralegal II must be able to use a computer data base for document management and file control.
The Paralegal II is responsible for maintaining the physical and electronic filing system of the documents maintained in the Appellate & PostConviction Section.
At the conclusion of a case, the Paralegal II is responsible for the archiving of files and records.
Research and Drafting - The Paralegal II will assist Section staff attorneys in responding to discovery motions, requesting the production of documents, and other matters involved in the prosecution of a capital case at the state and federal postconviction level.
Specifically, once a post-conviction case is assigned to a Section Attorney by the Supervisor, the Paralegal II will be responsible for organizing raw information which will then be used by the Section staff attorneys to draft the documents to be filed in the State Superior Courts, the Supreme Court of North Carolina, the Federal District Courts, the United States Court of Appeals for the Fourth Circuit, and the United States Supreme Court.
At the direction of the Supervisor or Section staff attorney, the Paralegal II may participate in the drafting of relevant documents in a case including the procedural history of the case, affidavits, motions, and other documents.
Contact Responsibilities - the Paralegal II will work closely with the Section staff attorneys regarding the scheduling of court dates; will assist in the transfer trial exhibits to the appellate courts, supplementing the record on appeal at the direction of the section attorneys, preparing for discovery, including ascertaining which law enforcement agencies were involved in the investigation of the case, establishing a contact person in such law enforcement agencies, obtaining all relevant investigative and prosecutorial files, reviewing the files, and preparation of the files for production.
The Paralegal II will also have contact with victims’ families to inform them of the status of a defendant’s case.
Miscellaneous and Clerical Responsibilities –the Paralegal II will share responsibilities with other support staff in the Section for regular clerical duties required of the Section support staff including copying, scanning, filing, and faxing; management of mail; calendar maintenance; making travel arrangements including motel/hotel, plane, car, and/or conference reservations needed by the Section attorneys and/or witnesses.
The Paralegal II will be responsible for preparing and submitting appropriate reimbursement paperwork, including Budget Authorization (BDA) forms and other necessary expense forms to the North Carolina Department of Justice Budget Office for payment.
The Paralegal II will be responsible for drafting basic letters of correspondence, with minimal review by the Section attorneys.
Note to Current State Employees: The salary grade for this position is LG04.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $53,585 to $55,728.
Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Knowledge, Skills and Abilities / Competencies The Paralegal II needs working knowledge of case law, statutory law and research skills to find the law.
This includes the traditional research methods as well as the modern computer research methods such as Lexis or Westlaw.
The Paralegal II must be able to interpret and summarize facts in evidence and prepare legal documents.
The Paralegal II must be able to communicate clearly and logically in both oral and written form.
Knowledge of word processing is required.
The Paralegal II should be a trained professional paralegal knowledgeable and skilled in legal research and various court rules.

Graduation from an appropriately accredited institution for paralegal training and two years of experience as a paralegal; Bachelor s degree from an appropriately accredited institution and two years of substantive paralegal experience; or High school or General Education Development (GED) diploma and six years of paralegal experience performing delegated, substantive legal work; or an equivalent combination of education and experience.
