The primary purpose of the North Carolina Department of Justice is to provide legal service to state government.
The primary purpose of the Transportation Section of the Department of Justice is to represent the North Carolina Department of Transportation (DOT) (including the Division of Motor Vehicles (DMV)) and the Board of Transportation.
The Transportation Section is divided into three units (1) Condemnation, (2) Contract Claims and Administration, and (3) Motor Vehicles.
Primary Purpose of the Position: The primary purpose of the Attorney II position is to advise the Department of Transportation on a wide variety of government contracting and operations legal issues.
While the legal matters handled by this position will be varied, the main focus of the duties will be in the area of environmental law, Outdoor Advertising, witness counsel for depositions, and claims for damage to the highway infrastructure caused by motorists.
Examples of these issues include, but are not limited to, issues arising from government enforcement actions against DOT, compliance with land, air, and water regulations, environmental permitting related to DOT projects, OSHA, and Dam Safety cases.
The Attorney II will advise DOT on Outdoor Advertising (Billboard) regulations and defend the agency for any challenge to billboard permits.
The Attorney II will also serve as witness counsel to DOT employees that are subpoenaed for depositions in matters where DOT is not a party.
The Attorney II prepares and litigates cases mainly filed in the Office of Administrative Hearings but may involve State and Federal cases as well.
The Attorney II advises DOT and drafts and negotiates conservation easements as well as advises DOT on issues involving mitigation sites and the stewardship and divestment of those sites.
The attorney may work, and/or assist other attorneys on miscellaneous litigation as necessary.
The attorney performs other such tasks that are incidental to the performance of the work of the Department of Justice and the Transportation Section, including representing the state in criminal appeals, responding to public inquiries, and approving contracts and bonds as to form.
Note to Current State Employees: The salary grade for this position is LG07.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $70,732 to $85,552.

Salary offers are based upon the candidate's education and experience related to the positions, as well as departmental budget and equity considerations.

** Knowledge, Skills and Abilities / Competencies This position requires a considerable knowledge of case, statutory, regulatory, and common law.
Considerable knowledge of civil procedure and the rules of evidence are required.
The attorney must be able to conduct civil litigation in the state and appellate courts.
This requires highly developed skill in analyzing facts and evidence, interpreting and applying statutes, regulations, and case law, developing creative case strategy and tactics, and expressing legal arguments and conclusions clearly, concisely, and convincingly both orally and in writing.
The attorney must have the ability to establish and maintain effective working relationships with DOT employees at all levels, the judiciary, lawyers, and co-workers.
Minimum Education and Experience Requirements Some state job postings say you can qualify by an “equivalent combination of education and experience.
” If that language appears below, then you may qualify through EITHER years of education OR years of directly related experience, OR a combination of both.

Licensed to practice law by the North Carolina State Bar and one year of professional legal experience.
